How statutory maternity pay works

Statutory Maternity Pay (SMP) is paid by your employer for up to 39 weeks. To qualify, you must have worked for your employer continuously for at least 26 weeks by the 15th week before your due date, and earn at least £123 per week on average.

How much will you receive?

  • Weeks 1–6: 90% of your average weekly earnings (no cap)
  • Weeks 7–39: £184.03 per week or 90% of your average weekly earnings, whichever is lower
  • Weeks 40–52: Unpaid leave (you can take up to 52 weeks total)

Key deadlines

You must tell your employer you're pregnant at least 15 weeks before your due date. You can start maternity leave from 11 weeks before your due date. Your employer must confirm your SMP within 28 days of your notification.

Enhanced maternity pay

Some employers offer enhanced maternity pay above the statutory minimum. Check your contract or employee handbook. Enhanced pay does not affect your right to take the full 52 weeks of leave.

When should I tell my employer I am pregnant?

Can I be made redundant while on maternity leave?

Your employer can make your role redundant, but you have special protection: you must be offered any suitable alternative vacancy in preference to other employees. Selecting someone for redundancy because of pregnancy or maternity is automatically unfair dismissal.

What if I do not qualify for SMP?

If you do not qualify for SMP (for example, you have not worked long enough), you may be able to claim Maternity Allowance from the government instead. This is currently £184.03 per week for up to 39 weeks.
